Terms of Service
These Terms govern your use of all services provided by Rainbow Web Solutions. Please read them carefully before purchasing or using any service.
Overview
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer") and Rainbow Web Solutions ("HostRainbow", "we", "us") governing the use of all services offered through our website and client portal.
By registering an account, placing an order, or using any service from HostRainbow, you confirm that you have read, understood, and agree to be bound by these Terms.
You must be at least 18 years of age to purchase or use our services. By agreeing to these Terms, you represent that you meet this requirement. Minors may use our services only with the involvement and consent of a parent or legal guardian.
HostRainbow reserves the right to amend these Terms at any time. The most current version will always be published on our website. Continued use of our services after any update constitutes acceptance of the revised Terms.
Definitions
For clarity, the following terms have the meanings set out below:
- "Services" — all hosting products, domain registrations, SSL certificates, software licences, and related services offered by HostRainbow.
- "Client Portal" — the WHMCS-based billing and account management portal accessible at my.hostrainbow.in.
- "Account" — the customer account created upon registration.
- "Agreement" — these Terms of Service together with our Privacy Policy, Acceptable Use Policy, and Unlimited Hosting Policy.
Pricing and Payments
All service pricing is published on our official website and is subject to change without prior notice. Prices are displayed in INR (Indian Rupee) or USD depending on your selected currency.
Invoices are automatically generated seven (7) days before the renewal due date. If payment is not received by the due date, the service may be suspended and subsequently terminated.
Accepted payment methods may include Credit Card, Debit Card, Net Banking, UPI, IMPS, RTGS, and NEFT. All payments are processed securely. HostRainbow does not store payment card details on its servers.
Late payments may result in a reactivation fee. Services suspended for non-payment may be terminated after 15 days if payment remains outstanding.
Service Renewals and Cancellations
All services operate on a prepaid basis. Customers are solely responsible for renewing services before the due date to avoid suspension or data loss.
Subscription-based services may be cancelled at any time through the Client Portal. Cancellation takes effect at the end of the current billing cycle unless an immediate cancellation is explicitly requested.
Refunds or credits are not applicable after the initial refund eligibility period. Please refer to our Refund Policy in Section 8 below.
Account Communications
By registering an account, you agree to receive service-related communications including billing notifications, service alerts, downtime notices, and policy updates via the email address registered to your account.
You are responsible for ensuring your contact details remain current in the Client Portal. HostRainbow is not liable for service interruptions resulting from outdated contact information.
Promotional communications may be unsubscribed from via the unsubscribe link in each email. Transactional and service-critical emails cannot be disabled.
Website Migration Policy
Where a hosting plan includes a free migration benefit, the following conditions apply:
- Migration is available between compatible platforms only (e.g., cPanel to cPanel).
- Free migration covers up to one (1) website per hosting account with a maximum total data size of 5 GB.
- Valid access credentials (cPanel, FTP, or SSH) must be provided by the customer.
- The source server must remain accessible and functional during the migration window.
- Migrations exceeding the above limits are available as a paid service upon request.
HostRainbow is not responsible for data loss resulting from incorrect credentials, inaccessible source servers, or third-party server-side issues.
Migration Timelines
Free migrations are typically completed within 24 to 72 hours of submission, subject to workload and complexity.
Priority paid migrations may be completed within 1 to 3 business days.
Customers are responsible for verifying all website functionality after migration is complete. Post-migration technical assistance is available for up to 7 days following completion of the migration.
Refund Policy
Refunds are subject to the following conditions and are limited to one (1) refund per customer.
Refunds will not be issued for accounts suspended or terminated due to policy violations.
The following services are non-refundable under any circumstances:
- VPS and Dedicated Servers once provisioned and delivered
- Offshore hosting services after activation
- Domain name registrations, renewals, or transfers
- SSL certificates
- Domain privacy or WHOIS protection services
- Software licences or installation services
- Custom development, configuration, or professional services
- Wallet balance or account credits
Service upgrades and downgrades are not eligible for refunds. Any applicable refunds are processed to the original payment method within approximately 10 business days of approval.
Intellectual Property
All content on the HostRainbow website, including but not limited to text, graphics, logos, icons, and software, is the property of Rainbow Web Solutions or its licensors and is protected by applicable intellectual property laws.
Customers retain full ownership of all content uploaded to their hosting accounts. By uploading content, customers represent that they hold all necessary rights and licences for that content.
HostRainbow does not claim ownership of customer content and will not use it for any purpose other than the delivery of contracted services.
Service Suspension and Termination
HostRainbow reserves the right to suspend or terminate services immediately and without prior notice in the following circumstances:
- Violation of these Terms of Service or our Acceptable Use Policy
- Non-payment of invoices beyond the grace period
- Activities that threaten the security, stability, or performance of our network
- Receipt of credible legal process or law enforcement directive
- Fraudulent account registration or chargeback disputes
Accounts terminated for policy violations are not eligible for refunds. Customer data may be deleted 30 days following termination.
Wallet and Credit Balance
Funds added to the HostRainbow account wallet or credit balance are non-refundable and non-transferable.
Wallet balance may only be used to purchase or renew services within the HostRainbow platform. Balances have no cash value and cannot be withdrawn.
Email and Anti-Spam Policy
HostRainbow enforces a strict zero-tolerance spam policy.
The following activities are prohibited:
- Sending unsolicited bulk email (spam)
- Operating email marketing campaigns without verifiable opt-in consent
- Email spoofing, phishing, or impersonation
- Exceeding 100 outbound emails per hour per shared hosting account
- Bulk mailing via shared hosting infrastructure
Accounts found engaging in spam or causing IP blacklisting may be suspended immediately without notice.
Force Majeure
HostRainbow shall not be held liable for any failure or delay in service delivery resulting from circumstances beyond our reasonable control. Such events include, but are not limited to, natural disasters, power failures, internet backbone disruptions, acts of government or regulatory authority, cyber attacks, pandemic-related restrictions, and failures of third-party infrastructure providers.
In such events, HostRainbow will make commercially reasonable efforts to restore services as quickly as practicable.
Limitation of Liability
To the maximum extent permitted by applicable law, HostRainbow shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of, or inability to use, our services.
Our total liability to any customer for any claim arising under these Terms shall not exceed the amount paid by that customer in the three (3) months preceding the claim.
Customers are solely responsible for maintaining independent backups of all website files, databases, and email data. HostRainbow's backup service is provided as a convenience and does not replace the customer's responsibility to maintain their own backups.
Dispute Resolution and Governing Law
These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of India.
In the event of any dispute between HostRainbow and a customer, both parties agree to first attempt to resolve the matter informally by contacting our support team. If informal resolution is unsuccessful within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of Ahmedabad, Gujarat, India.
Nothing in this clause prevents either party from seeking urgent injunctive or interim relief from a competent court.
Policy Updates
HostRainbow reserves the right to update these Terms of Service at any time. Updated versions will be published on our website with a revised "Last Updated" date.
For material changes, we may notify customers by email. Continued use of our services after the publication of updates constitutes acceptance of the revised Terms.
If you do not agree with any updated Terms, you must stop using our services and submit a cancellation request through the Client Portal.
