Acceptable Use Policy

    This policy defines what is and is not permitted on our hosting infrastructure. It applies to all services and customers without exception.

    Overview

    This Acceptable Use Policy ("AUP") governs the use of all services provided by Rainbow Web Solutions ("HostRainbow"). By purchasing or using any service, you agree to comply with this policy.

    This policy exists to protect the integrity, security, and reliability of our infrastructure — and to ensure a fair, stable experience for all customers sharing our network.

    Customers are solely responsible for all activities performed through their accounts, including actions taken by third parties with access to their accounts.

    HostRainbow reserves the right to modify this policy at any time. Changes become effective upon publication on our website.

    Prohibited Activities

    The following activities are strictly prohibited on our servers and network and may result in immediate service suspension or termination without refund:

    • Sending spam or unsolicited bulk email
    • Hosting or operating phishing pages, scam websites, or fraudulent services
    • Identity theft, impersonation, or financial fraud of any kind
    • Hosting or distributing malware, viruses, trojans, spyware, or ransomware
    • Operating botnet command-and-control (C2) servers or infrastructure
    • Running password cracking tools, brute force software, or network vulnerability scanners against external targets
    • Launching or participating in Distributed Denial of Service (DDoS) attacks
    • IP spoofing, packet flooding, or any form of network interference
    • Operating reverse proxy services intended to conceal malicious activity
    • Hosting hacking tools, exploit kits, or cheat software used for unauthorised access
    • Selling or advertising illegal pharmaceuticals, controlled substances, or firearms
    • Hosting terrorist propaganda, violent extremist content, or material promoting genocide
    • Hosting, storing, or distributing child sexual abuse material (CSAM) or any content that exploits minors

    Restricted Content

    In addition to the prohibited activities above, the following types of content are not permitted on our hosting infrastructure:

    • Child exploitation material of any form
    • Counterfeit goods, fake products, or brand impersonation storefronts
    • Illegal IPTV services or unauthorised streaming platforms
    • Pirated or cracked software distribution
    • Malware distribution platforms or trojan download sites
    • Websites designed to deceive users or compromise their security
    • Adult or sexually explicit content (all plans — no exceptions)

    Customers are responsible for ensuring all content hosted on their accounts complies with applicable laws in India and the jurisdiction of the end user.

    Email and Anti-Spam Policy

    HostRainbow maintains a zero-tolerance policy regarding email spam and abuse.

    The following activities are prohibited:

    • Sending unsolicited bulk email to addresses obtained by purchase, scraping, or harvesting
    • Using purchased or unverified email lists
    • Email spoofing, forging sender headers, or operating phishing campaigns
    • Hosting "spamvertised" websites linked in spam messages
    • Operating mail relay services or open mail relays

    Any account that generates spam complaints, causes IP address blacklisting, or is listed on spam blocklists such as Spamhaus may be suspended immediately.

    Organisations listed in the Spamhaus Register of Known Spam Operations (ROKSO) are not permitted to use our network.

    Resource Usage — Fair Use Policy

    Shared hosting operates within a multi-tenant environment where resources are shared across many customers. The following restrictions apply to maintain stability for all users:

    • CPU usage must not exceed 20% of a single core for more than 90 consecutive seconds
    • Background daemons, persistent server-side processes, or long-running scripts are prohibited
    • Web spiders, automated crawlers, or scraping tools may not be operated on shared servers
    • BitTorrent clients, trackers, or peer-to-peer services are not permitted
    • Gaming servers, voice servers, or IRC servers may not be hosted on shared plans
    • Cron jobs may not be scheduled more frequently than once every 15 minutes
    • Unlimited storage is intended for active website files only — not for file archiving, bulk media storage, or backup repositories

    Accounts found to be degrading server performance for other customers may be suspended until the issue is resolved or the customer upgrades to a VPS plan.

    Shared Hosting Environment

    Shared Hosting, Reseller Hosting, and Master Reseller plans operate within shared server infrastructure powered by CloudLinux OS.

    Each account is allocated a maximum amount of CPU, RAM, disk I/O, and concurrent entry processes via CloudLinux LVE (Lightweight Virtual Environment). These limits are enforced automatically to prevent any single account from impacting others.

    Accounts that consistently reach or exceed their resource limits will receive a notification to optimise their website or upgrade to a VPS or Dedicated Server.

    Network and Infrastructure Abuse

    Activities that threaten network stability, server integrity, or other customers are strictly prohibited:

    • Distributed Denial of Service (DDoS) attacks originating from our network
    • Port scanning or probing of external systems without authorisation
    • Packet flooding or bandwidth saturation attacks
    • Exploitation of vulnerabilities in third-party systems
    • Running open proxies, anonymising proxy networks, or VPN exit nodes
    • Any activity intended to interfere with the normal operation of the internet

    HostRainbow will cooperate with law enforcement agencies when presented with lawful requests relating to network abuse.

    Abuse Reports and Handling

    HostRainbow receives and investigates abuse reports from network providers, data centre operators, security organisations, and law enforcement.

    Types of reports we handle include:

    • Spam and email abuse complaints
    • Phishing and fraud site reports
    • Malware and botnet notifications
    • DDoS attack reports
    • Copyright infringement notices (DMCA)

    Upon receiving a credible abuse report, we may contact the customer for a response. Failure to respond or resolve the issue within a reasonable timeframe may result in suspension or termination of the service.

    Offshore Hosting — Additional Notes

    All prohibited activities listed in this AUP apply equally to offshore hosting services regardless of the jurisdiction of the server location.

    While DMCA-style takedown requests may not always result in immediate content removal for offshore services (depending on local laws), HostRainbow will comply with valid court orders, legal directives, and law enforcement requests from competent authorities.

    Offshore hosting does not provide immunity from criminal or civil liability, and does not exempt customers from this Acceptable Use Policy.

    Software Licensing

    Customers are responsible for ensuring that all software installed on their hosting accounts is properly and validly licensed.

    HostRainbow does not actively monitor installed software but may request proof of valid software licences if complaints are received from software vendors or copyright holders. Failure to provide proof of licensing may result in service suspension.

    Backups and Data Responsibility

    While HostRainbow provides automated backup services on most hosting plans, backups are offered as a convenience and are not a substitute for your own independent backup strategy.

    Customers are solely responsible for maintaining complete and independent backups of all website files, databases, and email data. HostRainbow shall not be liable for any data loss resulting from hardware failure, software malfunction, human error, or any other cause.

    Backup restoration requests are subject to availability and may be subject to a service fee.

    Billing and Refund Summary

    HostRainbow offers multiple billing cycles: monthly, quarterly, semi-annual, annual, and bi-annual, depending on the service.

    A 30-day money-back guarantee applies to new shared hosting plans only, as detailed in our Terms of Service. VPS, Dedicated Servers, Domain registrations, and Software Licences are non-refundable.

    Billing automation processes (invoice generation, suspension, and termination for non-payment) are executed automatically. Customers are encouraged to maintain active payment methods in the Client Portal to avoid interruption.

    Enforcement

    HostRainbow reserves the right to suspend or terminate any service that violates this Acceptable Use Policy, at our sole discretion.

    Enforcement actions may include:

    • Warning notification with a request to resolve the violation
    • Temporary suspension of the affected service or account
    • Permanent termination of the account with no refund for severe or repeated violations
    • Reporting to law enforcement or regulatory bodies where required by law

    Minor violations will generally receive a warning and a reasonable timeframe to correct the issue. Severe violations — particularly those involving illegal content, network attacks, or harm to other customers — may result in immediate termination without prior notice.

    Abusive or threatening behaviour directed at HostRainbow staff will result in immediate account termination without refund.

    Disclaimer

    HostRainbow shall not be responsible for any business losses, damages, or liabilities arising from service interruptions, delays, or data loss.

    Services are provided on an "as available" basis. HostRainbow makes no warranties, express or implied, regarding merchantability, fitness for a particular purpose, or uninterrupted service.

    HostRainbow reserves the right to modify service pricing, configurations, and policies at any time. Customers are bound by the most current version of all policies published on our website.

    Reporting Violations

    If you become aware of any activity on our network that violates this Acceptable Use Policy, please report it promptly to:

    All abuse reports are reviewed by our team. Please include as much detail as possible, including IP addresses, URLs, timestamps, and supporting evidence. Reports are handled confidentially.
